Will and Testament that is to Say Prinsiply and first of all I Give a nd

There is a marriage bond in loose marriage records of Lincoln Co ., Ke ntucky for John McCown and Nancy Johnston, 22 October 1801. Andr ew Jo hnston was also on the bond.

Malcom is apparently the second son of Francis to be named Malco m. Th e first came with the family from Ireland, and was called Markha m in the Orange Co., Virginia Order Books. He apprently died young. T his s econd Malcom was younger because of a statement in Francis' will : "I order that James pay macom five pounds when Come to the age of m enura ty...."

Malcom inherited a plantation from his father's will in 1761, wh ich h ad formerly belonged to Mathew Young. This must have been the la nd Fr ancis purchased 10 June 1757 from Peter and Martha Wallace for 5 6 pou nds. It was 150 1/2 acres on Whistle Creek in the Forks of the J ames River, with a corner to Low Todd [Augusta Co., Va. Deeds 7:453] . Pete r Wallace had purchased the land 4 Jan. 1750 from Mathew Youn g and Ag ness. It was originally purchased by James Young form Borde n (recorde d in Orange Co.) and conveyed by James to Mathew.

Malcom was a Revolutionary War soldier. He bought land in Kanawh a Co. , Va. in 1806 in Teas Valley. Malcom left a will which was writt en 2 4 Oct. 1813, and proven in Court 14 Dec. 1813.

I Malcom McCown of the County of Lincoln being
sick and weak of body; but of sound mind and
memory as touching such worldly estate as hath
pleased God to bless me with in this life. I hereby
devise and bequeath in the manner & form following
But first of all I order all my legal debts to be paid
1st I leave and bequeath to my wife Mary the one third
of all my real and personal estate during her
natural life and after her decease to be divided
among my children.

2d I leave and bequeath to my children named as
follows, John, Emalina, Lewis, Carrol, Moleena,
William Farlow and James Fletcher the remainder
of all my real and personal estate and to be divided
equally amongst them as they come of age and in
case of the death of any of the above named chil-
dren before they come of age, then and in that case
the part or share thereof pertaining to be equally
divided among the remainder.
3d I leave and bequeath to my daughter Lavina
Blair (otherwise McKeown so much as shall be of
value sufficient to make up the said Lavinas part
or share so as to amount to the same of any of the
others above named after the deduction of one
hundred and fifty dollars as taken out of the same
and making it on hers an equal to any of the rest
and said amount that is coming to said Lavina's
part to be paid as soon as all or the whole of the
money may be collected of said estate or so soon
as there is sufficient funds collected to discharge the
same.
And lastly I nominate and appoint my friends
William Barrow and George McKeown executors
of this my last will and testament hereby revo-
king all others or former wills or testaments
